safe tree?

ive seen a mini eating sweet cherry tree on ebay,is this safe

i noticed on the safe plant list on here that a black cherry tree would be toxic, is this the case for red cherry's as well.i just thought it looked quite bushy at the top which would go great in my viv,if not what sort of tree would produce a bushy top,something sturdy.i used to have a fiscus but i found it a bit weak in the branch area and not nearly bushy enough.
