LOL I came across a link to this website (www.pardalis.be/nosymitsio.htm) and was browsing pictures of Nosey Mitsio's and came across my own picture of my guy Gus! LOL. Damn people stole my picture.

That Nosy Mitsio of yours is absolutely incredible. Im looking to get a Mitsio as my next panther locale. Picture stealing sucks but i took a business law course a few semesters ago and i remember correctly that legally any photo without a COPYRIGHTED watermark/logo that specifies the photo is not to be used is fair game for use without permission on the internet. You dont really seem you care to much though. I'd take it as a compliment.:D

Ironically, you have hotlinked the image above and are stealing their bandwidth. :p

Seriously though, if that really is you image you should contact them. Nice looking chameleon.

I am Miwill, the webmaster of Pardalis.be
This picture was send by one of my visitor telling me that i can use it.
It was maybe 1,5 year ago.
This picture had no copyright and, in my mind,the owner of this animal was my visitor.

Being adult is strating to contact me and tell me that you are the real owner of this animal.
Asking pepeol to hotlink this image is more a child comportment.

I am a very conprehensive and honest person, not somebody closed to discution.

This picture is now deleted.

If i found this topic it is because i can see from where my visitors comes.
You increased my visits statistics creating this post, for this i thank you.
As many websites, our pages are hosted by paying and professional company without any limit of bandwich.
Hotlinking only makes loosing time.

Maybe reaname this post "Damn, i forgot to put my signature on pictures that i post on the web"

Just to bring another comprehensive laws on the copyright matters.
Basically, a creative object (including photograph) is protected by the law at the moment it is created by the creator (for US anyway).
So, if Nate decided to bring this to the court, his right will be protected.

I should know, cause I have sued somebody's bottom over this and won.
(someone stole my illustration and decided to make a logo of their company out of it).
This had resulted in a huge battle and it's well worth it in the end.
But to be fair, it's not the company's fault. But, rather, their graphic "designer" decided that it's ok to rip somebody else's illustrations and create a blatant copy of it and claim that he did the illustration. I do understand the term "inspiration", because i do draw my inspiration from other artists.
But there is a fine line between an inspired work and a blatant copy.

Just because an art does not have a big watermark or copyright logo on the image, does not mean that it is a free game for everybody.
In fact, you should even be more careful when you see a pure image. I do not and will not put watermarks over my illustrations because they are bothersome, incredibly ugly, and become distractions to my paintings. It becomes very hard for people like me, who rely on visual aesthetic to provide for my family, to smack ugly thing on my pictures.

For MiWill: I believe you when you said that was an honest mistake. But, i think the proper attitude is to apologize rather than "you should have done this etc etc.."

For Nate:
Just be sure that you put a comment that ALL contents on your web are copyrighted by the law. Also, when it happens again, you should contact the person and give him/her the benefit of the doubt and the chance to take it off his/her site.

People, just because it is flying around in the web, does not mean that you can just rip it off and claim it your own.
Please have some common decencies by contacting the owner and ask whether it's ok to post in your web or not.
Most likely you'll get the ok and avoid all this nightmare.

I just wanted to clarify photo copyright information since it is something I find myself dealing with far too often. A photograph is protected by copyright the second the shutter is snapped. It does not matter whether or not you put a watermark or copyright or name on the photo online, it is still legally your property and protected by copyright law. The photographer has no responsibility to put anything on the photo for it to be fully protected by copyright.

In my experience, use of your photos is usually either accidental (as was explained here) or simply an oversite that the individual is willing to correct rather willingly either by providing proper credit if you give permission for them to continue to use the photo or by removing the photo. In other cases where the individual is unresponsive or uncooperative, there are legal avenues to go through to handle it and in some cases, the user's hosting company could potentially be held liable if they fail to act. Miwill, I'm glad to see you were proactive in righting the situation as soon as you discovered it. That is definitely the most honorable course of action.

Nate, definitely try to contact the website owner if you see this again in the future as usually they will rectify the situation with a single email.

I was hungry because a topic with "stealer" on the title and my URL written on the first post of this topic, it is a very bad publicity.

I am not a strealer, I am honest, i tried to do it the best i could with "disclaimers" or "warnings" etc...,i am a lover of caméléons and a good part of my job on this website is made to help young breeders.

concerning "humor", i think before my intervention here, incitating to hotlink etc... is not humor, it was really ask to hurt me via my website.

Yes, I understand your dilemma. That's why I believe that it was an honest mistake.
A lot of people generally are uneducated in the matter of copyright laws.
Just learn from this experience.

no.
earning money or not, posting somebody elses' work or article without permission and proper citing is still stealing and (or) plagiarizing.
