My tortoise finally came out

Great!!!! It is very exciting.
Rascal came out after 3 months (few months ago).
He is so funny; he goes in headfirst to his burrow and backs out tail first.
He needs a backup beeper. :LOL: (y)

JMO- Enjoy other members experiences so more can be learned.
While looking up hibernation/brumation there is a 3rd. I must be a very very slow learner. (y)

I wouldn't assume; neither of those necessarily mean anything.
I don't find anything pertaining to AZ, but that doesn't mean anything either—just a cursory search.
Some Federal laws & regulations go back to 1988, but I haven't delved there either.

It's up to you, but I'd want to be on firm footing. JMO.

is it a gopher mine is named crush we thought it was a boy but was a girl its a gopher
 
Gopher tortoises are so lovely! My grandma has a preserve behind her home and they do their thing out there. Sometimes they make their way out of the preserve so I pick them up and gently place them back inside. Don't want them getting run over or eating grass with pesticides on it!
